SHOULD POLICE NEGLIGENCE BE A CRIME?

In August 2025, NYPD Officer Levonje Devone was patrolling Flushing Meadows Corona Park in Queens when she drove her patrol car over Erasmo Huerta Gonzalez, a man lying in the road. She was driving 7 miles per hour. She had one headphone in her ear and a tube of lip gloss in her hand. A nearby lieutenant and several civilians were yelling at her to stop. She didn't.

Huerta Gonzalez was pinned under the car. He was conscious when pulled out, but he died at a nearby hospital about 30 minutes after the crash. Devone refused to cooperate with investigators from the New York Attorney General's office. This last month, the AG concluded that a prosecutor could not prove criminal conduct beyond a reasonable doubt and declined to bring charges.

A man is dead. The officer who killed him won't face a single charge and still has her job. Whether that's justice or just how the law works depends entirely on who you ask.

POSITION A: She Should Be Charged
Driving with a headphone in your ear while ignoring people screaming at you to stop is negligence, and when negligence kills someone, there are usually consequences. The fact that she was in a patrol car shouldn't make her less accountable than any other driver who killed a pedestrian under the same circumstances.
POSITION B: Accidents Aren't Crimes
Criminal charges require criminal intent, and nothing in this case shows Devone meant to harm anyone. She was driving slowly, the sun was in her eyes, and the AG's own investigation called it an accident. Prosecuting officers for tragic mistakes made in the line of duty sets a precedent that makes the job nearly impossible to do.
